San Diego Short Sale Process avoids the Fiscal Cliff

San Diego Short Sale Process Debt Relief News

San Diego Home owners that are facing the need to use the short sale process just got a one-year reprieve. The American Taxpayer Relief Act of 2012 extended the Bush-Era relief that is designed to help folks that need to sell but owe too much to the bank. In some cases, there is the case that the bank would issue an IRS form“10980-C.”
According to San Diego short sale expert Gary Kent, this was keeping a lot of San Diego homeowners from using the short sale process near the end of 2012 since not only would they not get anything from the sale of their home, in some cases they would also owe taxes on the relieved amount of the cancelled debt. According to Kent “This is a big breather for home owners in trouble. Right now the market is very hot, with pent-up demand fueled by low interest rates. They may not get to the crazy highs of 2006/2007 but it is a nice time to sell their San Diego home. Most of the major lenders that we work with are very open to short sales and while it still takes time to short sell your San Diego home it is getting better.”

Divorce & The San Diego Short Sale Process

Divorce & The San Diego Short Sale Process

Divorcing? Need to sell your San Diego Home but there is no equity?

Unfortunately, one of the most common hardships facing San Diego home owners who are divorcing is the dilemma of having no equity or even negative equity in their San Diego home. One of the key elements of the short sale process is proving just such a hardship. Sadly, we have seen a trend with many of our short sale clients that they are also facing divorce, and it’s tougher when you owe too much on your San Diego Home. To find out how much your San Diego home is worth compared to owe much you owe, go to www.ShortOrStaySanDiego.com .

If you are facing divorce, you need to call San Diego short sale specialist Gary Kent at 858-457-5368 for a quick confidential analysis of your situation. We’ve dealt with the complexities of both divorce and short selling a San Diego home. Often times, divorcing couples are also facing a breakdown in communication.  We can't fix that, however we can work with both side in an appropriate way to help move the short sale process along.  And, while we cannot give you tax or legal advice, we can help you with the difficult situation of selling a home that is "upside down" in equity (you owe more than your home is worth). However, you should research with your attorney or tax adviser to address issues about financial liability, tax liability and if any liability will follow you after the short sale. The laws and rules on these liabilities continue to change (and don't always make common sense).

For more information on the short sale process, you should visit our website www.ShortOrStaySanDiego.com San Diego short sale expert Gary Kent has written the book on short sales. Gary would like to offer the San Diego Short Sale Guide to you for free – Click Here.

Don't Mail Your Keys To The Bank! San Diego short sale process

Are you ready to mail your house keys to the bank and walk away from your San Diego Home?  DON'T DO IT!!!

STOP, get away from the edge!  Before you do, read a little more about the Short Sale Process in San Diego. Even if you are ready to mail your house keys to the bank and walk away from your San Diego Home? That is a BAD idea. There have been several instances where the bank hasn’t foreclosed and the owner (yes, you still own it) is held liable for repairs, upkeep and city fines (especially in the City of Chula Vista).

There are also several other HUGE mistakes that San Diego home owners make when faced with foreclosure, big mistakes that can haunt them for years to come (Don't let your house become a Zombie that never dies!). In San Diego, the short sale process has changed. San Diego home owners are having more success with working with the bank to avoid foreclosure. Through programs such as HAFA and other efforts, there is a greater chance of having the bank take less than they are owed to help you sell your home.

So even if your San Diego home is worth less than you owe, Gary Kent and his team can help you sell it and avoid mistakes like "jingle mail." To learn how to avoid these mistakes, the first thing to do is to call San Diego short sale specialist Gary Kent at 858-457-5368 for a quick confidential analysis of your situation.

We have an extensive marketing program to attract home buyers and we may have someone right now who can buy your home. Plus, we have helped over 225 San Diego home owners short sell their home.

Avoid Foreclosure on your San Diego Home - use the Short Sale Process

San Diego Short Sale Process

How long before the Bank kicks you out of your San Diego Home?

Have you notice?  Banks are getting tougher! If you are unable to or have just stopped making payments on your San Diego Home, whether by choice or because of economic/family/health conditions, the bank will only wait so long before they start foreclosing on your San Diego home.

California's State Attorney General  recently signed an an agreement with the "Big Banks."  The recent multi-state, multi-billion dollar settlement solves a lot of the problems for the banks (not necessarily for you). If you want to avoid foreclosure you need to look at your options, including the short sale process.

FORECLOSURE PROCESS: After they have given you “proper notice” and have attempted to reach you to discuss options, they can start a foreclosure with a Notice of Default - and in as little as three months, they can file the next step which is called a Notice of Sale and in about 3 weeks they can hold an auction, so four months from the start they may have their attorneys knocking on your door with an eviction lawsuit. After the judge says okay, the next step is the San Diego Sheriff showing up on your doorstep to forcibly remove you.  IMPORTANT !!! If you are facing foreclosure, there are other options.

The first thing to do is to call San Diego short sale specialist Gary Kent at 858-457-5368 for a quick confidential analysis of your situation. We have an extensive marketing program to attract home buyers and we may have someone right now who can buy your home. Plus, we have helped over 200 San Diego home owners short sell their home.

Discretely sell your San Diego Home - short sale process

San Diego Short Sale Process

Looking for a discreet way to Short Sale your San Diego Home?

In today’s tough market (definition: you owe a LOT more than your home is worth!). What to do when you need to sell, and you want to handle it in a discreet way? The first thing to do is to call San Diego short sale specialist Gary Kent at 858-457-5368 for a quick confidential analysis of your situation.

We have an extensive marketing program to attract home buyers and we may have someone right now who can buy your home. Plus, we have helped over 220 San Diego home owners short sale their home.
The Gary Kent Team also markets to thousands of San Diego home buyers on a weekly basis with his weekly real estate e-newsletter. We work with first time home buyers, move up home buyers and investors (and everyone in between).
What this means to a San Diego home owner who is "underwater" (owe more than your home is worth), is that we may already have a home buyer ready to buy your home. In addition, we have an experienced short sale negotiation team in place. Short sales are easier than a few years ago but they still take time, patience and experience.
Our team understands the short sale process, especially how to coach a home buyer to stay in escrow during the difficult time.
So what is the first step in the short sale process if you want to discretely sell your San Diego Home? Usually it starts with how much your home is worth compared to how much you owe on it. If you owe more than it is worth, that is called being "underwater."
If you are not sure how “underwater” your home is, go to our website www.ShortOrStaySanDiego.com If you have told yourself "I don't want my neighbors to know that I need to short sale my home" or if you just want a quick discreet sale, then call Gary Kent at 858-457-5368. We understand that this is a difficult time and you may not want everyone around you to know that you are trying to avoid foreclosure or simply needing to do a financial reboot.
